Court upholds judgment against oil dealer

PORTLAND — Maine's supreme court today unanimously upheld the ruling against a former heating oil dealer accused of failing to deliver oil on prepaid plans during the winter of 2007-2008.

Nicholas Curro and his three companies – Price-Rite Oil, Veilleux Oil & Service and Perron Oil – were to pay $394,000 in restitution to more than 300 customers in an agreement reached last year. The arrangement approved by York County Superior Court Justice G. Arthur Brennan also included a fine of $250,000, which would be reduced to $25,000 if restitution was made within five years, and a ban on Curro entering into any prepaid oil deals for the next five years.

The businesses appealed to the Maine Supreme Judicial Court, arguing that the attorney general failed to provide 10-day notice before filing its complaint and that the lower court made a mistake in imposing the civil penalty when Curro didn't intentionally violate the state's Unfair Trade Practices law.

The justices found that the businesses failed to realize that there was an exception to the 10-day notice requirement in their case due to affidavits filled by the attorney general in support of a temporary restraining order it sought. The justices also found there was ample evidence to support the lower court's findings that Curro acted intentionally.

Hi, im a bit confused about this whole credit file thing, ive signed upto all 3 credit file agencys, but it doesnt seem to hold any info on a ccj that im supposed to have, i had a letter1 year ago saying my local county council had obtained a county court judgement for £1000, for housing benefit overpayment, (which wasnt even paid to me, direct to my landlord) anywho i went to court paid court costs straight away they never said anything about paying back the 1000 quid, then i received a letter saying they had another county court judgement for the same 1000, so i set up a payment plan, i have £85 left to pay….. so i thought i would go and check who to send the SETTLED letter to (what court) and non of the 3 credit file adgencys have any of file for me……im clean, so why do i get denied?????

how do i know for sure i have one?

i have 2 phone contracts, a morgage, but cant get any other credit it seems. cant even get a current account with my bank that i have been with for 14 years….. all paid, no missed payments, never been overdrawn, never had any problems apart from the bl00dy county council i want a credit card to help boost my credit file, capital 1 ive been denied, great!!!!

You didn’t by any chance sign up to checkmyfile.co.uk did you? If so, then I’m sorry to have to tell you that you have just wasted your money and will need to pay another £6 to get your proper statutory reports and find out what’s on them. The reports from checkmyfile DO NOT include all the information.

I had this problem recently too, not with CCJs but with searches – the reports at checkmyfile were all showing completely clean, no searches at all (even though I knew for certain I had been searched). Sure enough, I get my £2 report direct from Experian and there they all were.

no i checked them all,first experian, then equifax and then check my file….. nothing on any….

first of all i thought all credit searches and credit u have would be on any, and that all the above are the same company….but after reading helpful posts on here i learnt otherwise. and checked it out

Ok – so you sent £2 to each of the 3 agencies directly (Experian, Equifax and Callcredit) and received a statutory paper report from each? It’s just that when you said "signed up" that sounded like an online thing…

Checkmyfile is an online service which claims to be able to provide reports from all 3 of the agencies, but in fact the reports they give you are very incomplete.
